Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Christopher Parks ("Company," "we," "us," or "our") governing your access to and use of omnitrackagent.com and related services (the "Service"). By creating an account, clicking "I agree," or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and located in the United States. By using the Service you represent that you meet these requirements.

2. The Service — informational purpose only

The Service provides estimates and forecasts about residential real-estate markets in Southern California, generated from public and third-party data using statistical models. These are predictions and estimates — not statements of fact, appraisals, or guarantees. Markets are uncertain and forecasts may be wrong. Every forecast is shown with a confidence range, and actual outcomes may fall outside any range shown.

3. Not financial, investment, real-estate, or legal advice

The Service is for general informational purposes only and does not constitute financial, investment, real-estate, appraisal, tax, or legal advice, and creates no fiduciary or advisory relationship. You are solely responsible for your decisions. Do not rely on the Service as the sole basis for buying, selling, financing, or valuing any property. Consult qualified licensed professionals before making real-estate or financial decisions.

4. Accounts

Provide accurate information and keep your password secure. You are responsible for activity under your account and must notify us promptly of any unauthorized use.

5. Subscriptions, paid reports, and billing

• Membership costs $1.99/month and renews automatically each month until you cancel.
• On-demand property reports cost $0.99 each as one-time purchases.
• Payments are processed by PayPal and are subject to PayPal's terms; we do not store full payment-card numbers.
• You authorize recurring charges to your selected payment method for the membership until you cancel.
• Cancellation: cancel anytime; it stops future renewals effective at the end of the current billing period.
• Refunds: except where required by law, fees are non-refundable, including one-time reports and the current period's membership. Tips/donations are non-refundable.
• We may change prices prospectively and will notify you before a change affects you.

6. Acceptable use

You agree not to: disrupt or misuse the Service; scrape or access it by automated means except as expressly permitted; resell or redistribute its data or reports; reverse engineer it; infringe others' rights; or use it unlawfully.

7. Intellectual property

The Service — its software, models, text, and design — is owned by the Company and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Underlying public data remains the property of its sources.

8. Third-party data and links

The Service relies on third-party and public data and may link to third-party sites. We do not control and are not responsible for the accuracy of third-party data or the content or practices of third-party sites.

9. Disclaimer of warranties

THE SERVICE AND ALL FORECASTS, REPORTS, AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY FORECAST WILL BE ACCURATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA, OR PROPERTY VALUE, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON ITS FORECASTS OR REPORTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50. Some jurisdictions do not allow certain limitations, so some may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless the Company from claims and expenses arising out of your misuse of the Service or violation of these Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, incorporated here by reference.

13. Changes

We may modify the Service or these Terms. For material changes to the Terms we will notify you (via the Service or email) and update the Effective Date; continued use after changes means you accept them.

14. Termination

We may suspend or terminate your access at any time, including for violation of these Terms. You may stop using the Service at any time. Sections 2, 3, 7, 9, 10, 11, and 15 survive termination.

15. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

16. Informal resolution first

Before filing any claim, you agree to try to resolve it informally by contacting us at privacy@omnitrackagent.com and allowing 30 days.
